I. Definitions

The terms used in the Regulations mean:

1. Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, which places an Order within the Store;

2. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);

3. Regulations – these Regulations for the provision of services by electronic means within the online store bieznie.pl;

4. Online Store (Store) – online service available at https://bieznie.pl, through which the Customer may, in particular, place Orders;

5. Goods – products presented in the Online Store;

6. Sales Agreement – ​​a sales agreement for Goods within the meaning of the Civil Code, concluded between the bieznie.pl Store and the Customer, concluded using the Store’s online service;

7. Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827);

8. Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);

9. Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

II. General Provisions

1. These Regulations define the rules of using the online store available at https://bieznie.pl.

2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.

3. The online store bieznie.pl, operating at https://bieznie.pl, is run by MEDIA CONNECT Paweł Paśko, Anny Jagiellonki 14 lok. 10, 35-623, Rzeszów, NIP: 517-003-36-10, REGON: 691776917.

4. These Regulations specify in particular:

- rules for registering and using an account in the online store;

- terms and conditions for submitting Orders electronically within the online store;

- principles of concluding Sales Agreements using the services provided within the Online Store.

5. The use of the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements: None

6. In order to use the online store, the Customer should, at their own expense, obtain access to a computer station or terminal device with Internet access.

7. In accordance with applicable law, the bieznie.pl Store reserves the right to limit the provision of services via the Online Store to persons who are over the age of 18. In such a case, potential Customers will be notified of the above.

8. Customers can access these Regulations at any time via the link on the main page of the website http://bieznie.com.pl and download and print them."

III. Rules for using the Online Store

1. Registration in the Online Store is optional. The Customer may place an order without registering in the Store, after reading and accepting these Regulations.

Registration takes place by completing and accepting the registration form available on one of the Store's pages.

The condition for registration is to agree to the content of the Regulations and to provide personal data marked as mandatory.

The Bieznie.com.pl Store may deprive the Customer of the right to use the Online Store, and may also limit their access to some or all of the resources of the Online Store, with immediate effect, in the event of a breach of the Regulations by the Customer, and in particular when the Customer:

- provided false, inaccurate or outdated data, misleading data or data violating the rights of third parties, during registration in the online store,

- has violated the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,

- engages in other behaviors that are deemed by the Bieznie.com.pl Store to be inconsistent with applicable legal provisions or general principles of using the Internet or detrimental to the good name of the bieznie.pl Store.

A person who has been deprived of the right to use the online store cannot re-register without the prior consent of the bieznie.pl Store

2. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent via the Internet.

3. The Client is obliged in particular to:

not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties, using the Online Store in a way that does not disrupt its functioning, in particular through the use of specific software or devices, not taking actions such as: sending or placing unsolicited commercial information (spam) within the Online Store, using the Online Store in a way that is not burdensome for other customers and for the bieznie.pl Store, using all content posted within the Online Store only for personal use, using the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

IV. Procedure for concluding the Sales Agreement

1. In order to conclude a Sales Agreement via the Online Store, go to the website https://bieznie.pl, make a selection, taking subsequent technical steps based on the messages displayed to the Customer and the information available on the website.

2. The Customer selects the Goods to be ordered by adding them to the shopping cart.

3. During the Order placement process – until the button confirming the Order placement is pressed – the Customer has the option to modify the entered data and the selection of the Goods. To do this, the Customer should follow the messages displayed to the Customer and the information available on the website.

4. After the Customer using the Online Store has provided all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include, among other things, a description of the selected goods or services, the total price and all other costs.

5. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button confirming submission of the Order.

6. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and utility parameters and prices, constitute an invitation to conclude an agreement, within the meaning of Article 71 of the Civil Code. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the bieznie.pl Store, in accordance with the Regulations. After placing an Order, the Customer receives an e-mail containing all the essential elements of the Order. The Agreement is treated as concluded at the moment the Customer receives the e-mail referred to above.

7. The sales agreement is concluded in Polish, with content consistent with the Regulations.

V. Delivery

1. Delivery of Goods is limited to the territory of the Republic of Poland and takes place to the address indicated by the Customer when placing the Order.

2. Delivery of the ordered Goods is carried out via:

- Polish Post - delivery time maximum 7 working days

- Courier company - delivery time maximum 3 working days

It is possible to collect the ordered goods in person at our store: MEDIA CONNECT Anny Jagiellonki 14 lok. 10 35-623 Rzeszów. Details of the personal collection of goods should be agreed by phone before placing the order.

Shipping costs are: Shipping costs depend on the product purchased. In order to determine shipping costs, we recommend contacting us by phone before purchasing. Additionally, shipping costs will be indicated when placing the Order.

3. The delivery date depends on the availability of products at a given time and is counted from the day the Customer sends the Order.

4. Customers can access these Regulations at any time via the link on the main page of the website https://bieznie.pl and download and print them.

The recording, securing and provision of order data and the General Terms and Conditions (sales regulations) is done via e-mail. For security reasons, order data is not available via the Internet.

VI. Prices and payment methods

1. The prices of the Goods are given in Polish zloty and include all components, including VAT (with the rate indicated), customs duties and all other components.

2. The customer has the option to pay the price:

- by transfer

- cash on delivery

- payment via PayU system
Additional fee of: 3%

- PayPal payment
Additional fee of: 3%

- Cash in case of personal collection

- in installments (eRaty Santander)

VII. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the day on which you came into possession of the last batch or part or on which a third party other than the carrier and indicated by you came into possession of the last batch or part.

To exercise your right to withdraw from the contract, you must inform us (MEDIA CONNECT Paweł Paśko, Anny Jagiellonki 14 lok. 10, 35-623 Rzeszów, biuro@bieznie.pl, Phone: +48 792 792 160) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the model withdrawal form, but this is not obligatory.

In order to meet the withdrawal deadline, it is sufficient for you to send information regarding the exercise of your right to withdraw from the contract before the withdrawal deadline expires.

Consequences of withdrawal from the contract

If you withdraw from this contract, we will reimburse you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), immediately and in any event no later than 14 days from the day on which we are informed of your decision to exercise your right to withdraw from this contract. We will make the reimbursement using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods or until you have provided us with proof that you have sent them back, depending on which event occurs first.

Please return or hand over the item to us or MEDIA CONNECT Paweł Paśko ul. Anny Jagiellonki 14 lok. 10 35-623 Rzeszów, immediately and in any case no later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you return the item before the expiry of the 14-day period. You will have to bear the direct costs of returning the item. The amount of the costs of returning items that, due to their nature, cannot be returned by post in a normal manner is PLN 300. You are only liable for the diminished value of the item resulting from its use in a way other than necessary to establish the nature, characteristics and functioning of the item.

    The right of withdrawal by the consumer is excluded in the event of:
  • Contracts under which the subject of the provision is a non-prefabricated item, manufactured according to the consumer's specifications or intended to meet his individual needs.
  • Contracts in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires.

VIII. Complaints about Goods

1. The bieznie.pl store, as a seller, is liable to the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 and Art. 556[1]-556[3] of the Civil Code.

2. Complaints resulting from a violation of the Customer's rights guaranteed by law or under these Regulations should be sent to the following address: MEDIA CONNECT Paweł Paśko, Anny Jagiellonki 14 lok. 10, 35-623, Rzeszów, biuro@bieznie.pl. The bieznie.pl store undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

The Bieznie.com.pl Store is the manufacturer of selected Goods available in the Store. In relation to these Goods, the bieznie.pl Store as the manufacturer is liable under the guarantee of the sold Goods on the terms and for the period indicated in the guarantee card. In relation to Goods that are not manufactured by the bieznie.pl Store, the manufacturer may be independently liable under the guarantee of the sold Goods on the terms and for the period indicated in the guarantee card issued by the manufacturer. If the manufacturer's guarantee document provides for such a possibility, the Customer may submit their claims under the guarantee directly to an authorized service center, the address of which is provided in the guarantee card. All Goods available in the Store are independently covered by the bieznie.pl Store as the seller. The bieznie.pl Store is liable under the guarantee of the sold Goods on the terms and for the period indicated in the guarantee card.

IX. Complaints regarding the provision of services by electronic means

1. The bieznie.pl Store takes steps to ensure the proper operation of the Store, to the extent that results from the current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.

2. The Customer is obliged to immediately notify the bieznie.pl Store of any irregularities or interruptions in the functioning of the Online Store service.

4. In the complaint, the Customer should provide his/her name and surname, correspondence address, type and date of the irregularity related to the operation of the Store.

5. The bieznie.pl store undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

X. Final Provisions

1. Any disputes arising between the bieznie.pl Store and the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code shall be referred to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

2. Any disputes arising between the bieznie.pl Store and the Customer who is not a consumer within the meaning of Art. 22[1] of the Civil Code shall be submitted to the court with jurisdiction over the seat of the bieznie.pl Store.

3. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of services by electronic means and other relevant provisions of Polish law shall apply.
